We’ve all been there. You’re driving down a two-lane road when the vehicle ahead slows to make a left turn. Can you legally pass on the right using the shoulder?
In Texas, the answer is yes, under certain conditions.
Under Texas Transportation Code § 545.058, drivers may use a paved shoulder to pass a vehicle that is slowing, stopped, disabled, or preparing to turn left, provided the maneuver is necessary and can be completed safely.
The law applies to Texas roadways, including FM roads around Benbrook. However, drivers must watch for pedestrians, cyclists, and other hazards. Passing on an unpaved shoulder is not permitted under this provision.
So, the next time you’re waiting behind someone turning left, remember that using the paved shoulder may be legal. Just make sure it’s safe before making your move.
